The German Freight Forwarders’ Standard Terms and Conditions
The German Freight Forwarders’ Standard Terms and Conditions, ADSp for short, are guidelines that apply to classic transportation, handling and storage services (TUL) in logistics. These terms and conditions also regulate additional, standard forwarding services, but not trade or production-related activities.
A central aspect of the ADSp is the limitation of liability, which is of great importance for logistics service providers. Sections 23 and 24 of the ADSp in particular contain important regulations on the limitation of liability. These provisions serve to limit the liability of the logistics company in various situations.
It is essential to understand that, according to prevailing opinion, the ADSp are applied by commercial practice, but this point is not uncontroversial. It is therefore important for logistics companies and their customers to examine the ADSp carefully and be aware of how the liability rules apply in individual cases.
The ADSp provide a clear structure for the handling of logistics services and create transparency regarding responsibilities and liability regulations. Logistics companies should ensure that their customers understand the ADSp and customers should be aware of their rights and obligations.
In situations where specific requirements exist or uncertainties arise, it is advisable to seek legal advice from experts. A sound understanding of the ADSp not only facilitates business transactions, but also helps to minimize potential legal conflicts.
